PROJECT: MISREPRESENTATION, FRAUD AND THEFT – MR LOUIS LIEBENBERG AND MISSING PERSON – MR HEINLOU JOOSTE (PART 2)

  • On 28 May 2024, we published an in-depth (project) report on Mr Louis Liebenberg and our organisation's ongoing investigation into the alleged theft of fifty million rands’ worth of diamonds and the disappearance of Mr Hein Jooste.

  • We also reported on Mr Liebenberg's ongoing fraudulent activities, as claimed in the media saga of the liquidation of Tariomix.

  • Following this project, Mr Liebenberg filed an urgent application against Mr Bolhuis to have our project removed from our website.

  • On 11 June 2024, Mr Bolhuis’s legal team, headed by Senior Counsel Adv Francois Botes, Adv Jané Stroebel, and Me Chenique Opperman, presented to the urgent court that Mr Liebenberg’s application is by no means urgent, especially under circumstances where Mr Liebenberg himself is sharing and spreading the content of our project to his 160 000 followers and everyone else willing to listen.

 

The court ruled that Mr Liebenberg's application was not urgent and dismissed his case with costs.


This means Mr Liebenberg will have to cover the legal expenses incurred by Mr Bolhuis

in defending against the unfounded urgent application.

 

REGULATED MINING PROTOCOL VS LOUIS LIEBENBERG MINING PROTOCOL:


  • The manner in which Mr Liebenberg trades with diamonds is completely irregular.

  • Diamonds are allegedly mined, polished, and traded, the “investors” are never granted an opportunity to inspect, evaluate or confirm the value and legitimacy of the diamonds they are investing in.

  • Any person who purchases a diamond is given a certificate of authentication that proves the diamond’s legitimacy, colour, cut, clarity, and size - yet Mr Liebenberg shows only pictures of diamonds that could have been downloaded from anywhere on the Internet.

  • The “investors” are never afforded an opportunity to confirm the safekeeping of the diamonds; they do not get to see where the diamonds are stored or with whom they are stored.

  • Based on recent events, Mr Liebenberg alleged he was storing diamonds, gold coins and other valuables to the value of R50 Million in a living room closet inside a gas bottle.

  • No factual evidence of the existence of these valuables could be found - thus there is no proof of an actual theft having occurred.

  • Mr Liebenberg’s total lack of security awareness regarding highly regulated minerals is shocking.

  • By Mr Liebenberg’s own account, he does not know which diamonds were stolen from the gas bottle; this again shows negligence with the storage and proper record-keeping procedures that are expected when trading in minerals.

  • “Investors” are not offered insurance on the products they invested in; thus, recent events bring Mr Liebenberg’s total lack of security protocol into question.

  • Surely, “investors” in highly regulated minerals should have questions concerning security and insurance.

  • Mr Liebenberg’s lack of accurate record keeping suggests that he is uncertain which diamonds were in the gas bottle during the “alleged theft; how does he keep record of which diamonds belong to which “investor”?·

  • “Investors” are constantly being told that they need to “invest” more money, otherwise they will be cut from the books.

  • Surely, diamonds that have already been sold to a person cannot be sold to another person as well, especially if the diamonds have not been sold back to Mr Liebenberg - that would be considered fraud.

  • Safe buying and selling protocol for anything, anywhere in the world indicates that a buyer must practice caution when purchasing a product:

    • Always inspect the product.

    • Always ensure the origin of the product is legal and known.

    • Always ask for proof of previous purchase of the product.

    • Always ensure that the product is of good quality.

    • Always take or receive proof of ownership of the product.

  • Mr Liebenberg’s investors are satisfied with only his word that the products exist and are legal.

  • Mr Liebenberg blocked previous investors when they asked basic questions that were standard in any business relationship.

  • Mr Liebenberg threatened and intimidated the investors who did not want to continue investing, stating that they would lose what they had already invested.

  • Mr Liebenberg blocks, threatens and intimidates those who dare to comment negatively, warn others or expose his dealings on social media.

  • He states clearly that he will not pay anybody who acts against him in any way.

  • His current investors are satisfied that he will not repeat this behaviour with them.

FSP-ACCREDITATION:


  • Neither Mr Louis Liebenberg nor Mrs Desiree Van Schalkwyk (Liebenberg) has any current FSPs registered in their names.

  • A company search was run on all 17 companies of which Mr Liebenberg either is or was director, only one result was returned.

  • This result refers to Street Spirit Trading 234 (PTY) LTD and was withdrawn on the 21st of February 2013.

  • Coequally, a company search was run on Mrs Desiree Liebenberg, which also returned no results.

  • It seems that Mr Liebenberg is trying to capture the concept of Discovery Bank (which is legally compliant).

  • Contrary to Mr Liebenberg’s setup, Discovery provides its clients with registered brokers.

  • It is concluded that Mr Liebenberg has no legal standpoint that enables him to deposit any individual’s money on their behalf into an e-wallet.

  • There is no legal standpoint on which Mr Liebenberg is able to promise a positive return on the above-mentioned money.

  • Mr Liebenberg is obligated to provide these individuals with a contractual agreement between himself and the company into which the money was deposited.

  • No matter what legal compliance Mr Liebenberg, his wife, or their companies might have, if there is no FSP for conducting business as mentioned above, all other compliances are null and void.

  • It is a non-negotiable requirement to be a registered FSP in a business practice of this nature.

 

SOCIAL MEDIA MISINFORMATION:


  • Shortly after the verdict in the urgent case against Mr Bolhuis was announced, Mr Liebenberg announced on social media that he intends to continue with the application by following standard court proceedings, a confirmation reiterated by his legal representatives.

  • Mr Bolhuis’ legal team, equipped with his instructions, will oppose the application should it be enrolled on the opposed motion roll and, similarly, any other legal proceedings instituted against Mr Bolhuis, of which Mr Liebenberg has already published his intention.

  • Mr Bolhuis is willing to amend, suspend or remove the project on the condition that Mr Liebenberg cooperates fully during the investigations of SSS, the HAWKS, the SAPS and the liquidators.

  • Mr Liebenberg refuses to do so.

  • Mr Liebenberg uses social media platforms to spread disinformation and misinformation.

  • Take note that Mr Mike Bolhuis, any member of SSS and its legal representatives have not reacted on any social media platform regarding this or any other case.

  • Social media has become a platform for spreading falsehoods and misinformation.

  • If information is not based on facts, it should not be entertained or shared.

  • Hearsay and assumptions on social media create misinformation and misunderstandings.

  • Sharing unverified information or making assumptions based on incomplete facts can lead to rumours, false conclusions, and even public panic.

  • This contributes to distrust and confusion, where accurate information becomes obscured by speculation and biased interpretations.

  • Verifying information before sharing it and critically evaluating sources is essential.

THE HEINLOU JOOSTE INVESTIGATION:


  • Mr Heinlou Jooste is still missing, the investigation is at a critical stage.

  • Mrs Libby Jooste - Mr Jooste's wife, has appointed Mr Mike Bolhuis and the SSS Task Team to assist in the search for her husband.

  • Mr Bolhuis is acting on behalf of the whole Jooste family.

  • Mrs Jooste was recently threatened and intimidated, she had to obtain a protection order interdict against Mr and Mrs Liebenberg to ensure that they stay away from her residence and to prevent all forms of communication.

  • SSS will inform the public of new developments regarding Mr Jooste.
