THE CIRCUMSTANCES:
2-Year-old Chevonne Rusch was admitted on 11 May 2022 to the Primrose Clinic in Germiston.
On arrival, this little girl was declared deceased.
Her mother and hermother's boyfriend were found guilty on the 17th of November 2023, of several charges, including but not limited to:
Murder.
Attempted murder.
Rape.
Human trafficking.
Child Abuse.
Child Neglect.
After sentencing, Botha arrogantly applied for leave to appeal.
To the relief of SSS and other interested parties, this was denied.
Decision on Appeal Application:
Botha was found guilty of serious crimes, including rape, sexual assault, child abuse, attempted murder, and murder, and was given a 25-year prison sentence.
Reasons for Appeal:
Botha claimed that the Court did not believe her side of the story, even though it could have been true.
The Court argued that she gave several different versions of events, so it was fair for the Court to not believe her.
Evidence Presented:
During the trial, the Court heard from two other children of Botha, who survived the abuse.
They said she knew about the abuse and either watched it happen or did not stop it.
Botha did not protect her children or stop the abuse.
The children told other adults about the abuse, but Botha went so far as to hide the visible injuries and, in this manner, prevented others that could have possibly intervened to help the children.
Doctors confirmed the injuries from the abuse were visible.
Botha even sent one of the boys away because she could not handle the abuse from her partner, Van Niekerk, of this child anymore.
According to this testimony, Botha "got tired" of it.
She did not respond to the children's accusations during the trial, saying she did not want to upset the kids further.
The Court took this as agreement with the children's version of events.
Unchallenged evidence is accepted as true by the Court.
Conclusion:
The children's testimony seemed more believable than that of the guilty couple, who did not give a consistent story or respond to the accusations.
The Court sided with the Court's version of events.
Outcome:
The appeal was rejected because it did not seem likely to succeed, and the Court still believed the mother was guilty.
The original conviction and 25-year sentence stand.
