THE DARK SIDE OF TOWING:

  • TARGETING VULNERABLE MOTORISTS:

    • Scammers often monitor accident scenes or use connections (like corrupt officials or spotters) to arrive quickly after a collision, sometimes even before emergency services.

    • They prey on stressed, confused, or injured motorists, making them more likely to trust someone offering immediate help.

  • DECEPTIVE TACTICS AND FALSE AUTHORITY:

    • Tow truck drivers may ask for the motorist's insurance details under the pretence of assisting them.

    • They might then stage a fake phone call with someone posing as an insurance representative.

    • This "representative" provides misleading advice, such as warning against moving the vehicle due to supposed safety risks (e.g., airbag deployment) or claiming the insurer would not cover damages if they do not tow the car.

  • UNAUTHORISED TOWING:

    • Once the motorist agrees to the tow, the vehicle is taken not to an accredited repair shop or a location approved by the insurer, but to the tow company's premises or an unapproved facility.

    • This is often done without the motorist's complete understanding or consent.

  • EXTORTIONATE FEES:

    • After towing the vehicle, the scammers hold it "hostage," demanding exorbitant fees for its release.

    • These fees can include inflated towing charges, storage costs, or fabricated repair assessments.

    • If the motorist refuses to pay, the company may threaten to keep the vehicle, sell it, or impose additional penalties, leveraging the motorist's desperation to recover their car.

  • EXPLOITING LEGAL AND INSURANCE GAPS:

    • Many of these operators are unregistered or operate in a legal grey area, making it harder for victims to seek recourse.

    • They may also exploit the motorist's lack of knowledge about their rights or insurance processes, pressuring them into quick decisions.

PROACTIVE STEPS MOTORISTS MUST TAKE TO AVOID FALLING VICTIM TO THESE SCAMS:

  • VERIFY THE TOW TRUCK OPERATOR:

    • Always ask for identification and proof that the tow truck driver is affiliated with a legitimate, registered company.

    • Reputable operators should have credentials or be linked to your insurance provider or a known repair network like SAMBRA-accredited shops.

  • CONTACT YOUR INSURANCE PROVIDER DIRECTLY:

    • After an accident, call your insurance company using the official contact number from your policy documents – make sure you have this number saved as a contact on your phone!

    • Do not rely on the tow truck driver to do it for you.

    • Confirm whether they have dispatched a tow truck and where your vehicle should be taken.

    • Avoid sharing insurance details with unverified individuals.

  • WAIT FOR AUTHORITIES IF POSSIBLE:

    • If you are unsure, wait for police or traffic officials to arrive at the scene.

    • They can arrange a legitimate tow service or verify the operator's authenticity.

    • This is especially useful in cases where the tow truck shows up suspiciously fast.

  • KNOW YOUR RIGHTS:

    • Understand that you are not obligated to accept a tow from the first truck that arrives.

    • Unless an emergency requires immediate removal (e.g., blocking traffic), you have the right to choose where your vehicle is towed.

    • Insist on it being taken to an accredited repair shop or a location approved by your insurer.

  • DOCUMENT EVERYTHING:

    • Take photos of the accident scene, the tow truck (including its license plate and company branding), and the driver.

    • Get a written agreement or receipt detailing the towing destination and costs before allowing the vehicle to be moved.

    • This can serve as evidence if disputes arise.

  • BE WARY OF RED FLAGS:

    • Be cautious if the tow truck arrives unusually quickly without being called, pressures you to act immediately, or refuses to provide transparent information about fees or the destination.

    • These are common tactics used by scammers.

  • REPORT SUSPICIOUS ACTIVITY:

    • If you suspect a scam, report it to the police and your insurance company immediately.

    • Organisations like SAMBRA or consumer protection bodies can also assist in raising awareness and taking action against fraudulent operators.

This scam reflects a broader trend of predatory towing practices, increasingly reported.

The SA Motor Body Repairers' Association (SAMBRA) has noted a rise in such incidents, with tow truck operators exploiting the chaos of accidents to maximise profit. Unlike legitimate breakdown services, these scammers operate with little oversight,

often in cahoots with shady repair shops or salvage yards. The emotional and financial toll on victims can be immense, especially if they lose access to their vehicle or face unexpected costs.

By staying vigilant, verifying services, and relying on official channels, South African motorists can significantly

reduce their risk of being scammed by these unscrupulous tow truck drivers.

Awareness and preparedness are key to turning the tables on these deceptive tactics.
