Property hijacking has emerged as a significant issue in South Africa, affecting commercial and residential areas.


This crime involves the illegal seizure of property through fraudulent means,

and it has increasingly targeted homes in residential neighbourhoods, a shift from its previous concentration

in industrial areas and city centres.

CURRENT TRENDS AND RISING CONCERNS:

  • Shift to residential areas:

    • Over the past decade, property hijacking, once predominantly affecting neglected or abandoned commercial buildings in city centres, has begun to impact residential neighbourhoods.

    • This shift poses new challenges for homeowners and local authorities as criminals move from industrial CBDs to more populated areas.

  • Criminal syndicates and corruption:

    • Reports indicate that well-organised criminal syndicates are now infiltrating residential areas.

    • These groups often collaborate with individuals within the deeds office to forge ownership documents, thereby taking control of properties.

    • For instance, these syndicates sometimes obtain legal papers from the deeds office, making it difficult for legitimate owners to reclaim their homes.

  • Vulnerable properties:

    • Properties that are particularly susceptible to hijacking include those owned by absentee landlords - particularly those residing outside the province or country - and estates of deceased individuals.

    • The hijackers target these properties and rent them out to unsuspecting tenants, exploiting the legal vulnerabilities of these situations.

  • Challenges for authorities:

    • The rise in residential property hijacking has led to an increase in urban decay, crime, and loss of revenue in cities like Johannesburg.

    • The Johannesburg Metropolitan Police Department (JMPD) and other city officials are actively involved in reclaiming these properties but face numerous obstacles, including legal battles and threats of violence from hijackers.

    • The City of Johannesburg’s Group Forensic and Investigation Services (GFIS) reports hundreds of illegally occupied buildings contributing to these problems.

  • Government response:

    • National and local government officials are aware of the escalating issue.

    • The Department of Human Settlements has noted the need for stricter legislation and enforcement to protect property rights and address the housing shortages contributing to illegal occupations.

    • Efforts are underway to identify and address corruption within the deeds office, with collaboration between the South African Police Service (SAPS) and municipal officers to tackle this concerning trend.

    • Property owners should frequently check their property records with the Deeds Office to ensure there are no unauthorized changes.

  • Secure documentation:

    • Safeguard original property documents and be cautious when sharing property information.

  • Tenant verification:

    • Vet tenants carefully and ensure all rental agreements are legal and verifiable.

  • Legal assistance:

    • Consult with property attorneys to address any concerns or suspicious activity related to property ownership.

  • Report suspicious activity:

    • If you suspect property hijacking, report it to the police and seek legal advice promptly.

 

Property hijacking represents a growing and serious threat to property owners across South Africa, particularly in residential areas. It is also critical to understand that this type of crime can quickly escalate to extreme extortion and violence.
