Hunting plays a vital role in South Africa's tourism and conservation sectors. Hunting farms like Shingalana offer international clients the opportunity to engage in professional trophy hunting, contributing significantly to local economies. However, incidents like the one involving Mr. Danie Appelgryn and Derby Safaris highlight a growing risk for farm owners: defaulters who exploit the system and fail to pay for services rendered.
In this case, Mr. Appelgryn organised a hunting trip at Shingalana, where he facilitated the game shooting for trophy purposes. Despite completing the hunt and making numerous promises, he defaulted on a payment of R110,000.00
owed to the farm. Attempts by the farm owner to recover the outstanding amount were met with delays and partial payments,
leaving the farm at a financial loss. The client, deeply distressed and frustrated by the financial loss incurred,
sought assistance from SSS to mediate with Mr. Danie Appelgryn and recover the outstanding fees.
This unfortunate event underscores the need for hunting farm owners to adopt robust measures
to protect themselves from potential defaulters.
PROTECTING HUNTING FARM OWNERS FROM DEFAULTERS
SAFETY MEASURES TO AVOID DEFAULTERS:
IMPLEMENT DETAILED CONTRACTS:
Draft comprehensive contracts that clearly outline payment terms, deadlines, and penalties for non-compliance.
Include clauses that require deposits upfront (e.g., 50%) before the hunt begins and full payment before the client leaves the premises.
VETTING:
Conduct thorough background checks on hunters, representatives, and businesses like Derby Safaris.
Verify their history and reputation within the hunting industry by contacting previous clients or farms they've worked with.
REQUEST FINANCIAL SECURITY:
Insist on bank guarantees, letters of credit, or surety bonds for significant transactions.
These mechanisms provide financial security if the client defaults on payment.
INDUSTRY WATCHLIST:
Collaborate with other hunting farms and industry associations to create a shared database of defaulters or individuals with questionable reputations.
Warn peers in the industry about specific entities or individuals, such as Mr. Danie Appelgryn.
UTILISE PROFESSIONAL MEDIATION EARLY:
Engage a reputable mediation service, such as SSS, at the first sign of non-payment to recover outstanding debts efficiently.
ADOPT PAYMENT TECHNOLOGY:
Use secure online payment platforms that require upfront deposits and allow payment tracking.
Avoid reliance on verbal promises or postdated payments.
INSURANCE:
Explore insurance policies designed for hunting and farming industries to cover potential losses from client defaults.
LEGAL RECOURSE:
Prepare to pursue legal action promptly in case of non-payment.
Issue legal notices and seek advice on recovering debts through civil court procedures.
WARN THE PUBLIC:
Use your platforms to caution others about fraudulent operators.
For example, publicise cases like Derby Safaris to prevent others from falling victim.
BUILD A NETWORK OF TRUSTED PARTNERS:
Partner with reputable hunting agencies and professional hunters who value ethical practices.
Verify their certifications through organisations like PHASA (Professional Hunters' Association of South Africa).
The hunting industry thrives on trust, professionalism, and mutual respect. Cases of defaulting, such as those involving
Mr. Danie Appelgryn and Derby Safaris tarnish the industry's reputation and harm ethical business owners.
By adopting these safety measures, hunting farm owners can mitigate risks, recover losses more effectively,
and uphold the integrity of South Africa’s hunting sector. Staying vigilant, conducting due diligence, and fostering strong industry collaboration is key to safeguarding businesses and ensuring fair practices for all parties involved.
SSS remains steadfast in addressing this case of non-payment, with its specialist investigators actively exploring
all available options to recover the outstanding amount and ensure fair reimbursement for our client.
