PROJECT: NEW CCTV BY-LAW IN JOHANNESBURG

The City of Johannesburg has recently introduced a new by-law regulating the installation and use of CCTV cameras

monitoring public spaces. It is critical that the community is informed about these changes and their potential impact.

KEY PROVISIONS OF THE BY-LAW:

  • MANDATORY REGISTRATION AND APPROVAL:

    • All private CCTV cameras that capture public spaces, including streets and sidewalks, must be registered with the City of Johannesburg.

    • Approval is required before installation, and licenses must be renewed annually.

  • DATA HANDLING AND CONFIDENTIALITY:

    • Footage collected by private cameras is strictly for security purposes and must be stored securely.

    • Only authorised personnel, the Johannesburg Metropolitan Police Department (JMPD), and the South African Police Service (SAPS) may access the footage.

    • Sharing CCTV recordings on social media is strictly prohibited.

  • PROHIBITED INSTALLATIONS:

    • Temporary installations and unauthorised drone surveillance are banned.

    • Special approval is required to install cameras near government buildings, bridges, traffic lights, SAPS facilities, and other City-owned properties.

  • FEES AND PENALTIES:

    • Camera owners must pay prescribed fees for registration, renewal, and compliance.

    • Violations can result in fines, imprisonment of up to two years, or both.

 

CONCERNS AND CHALLENGES:

While the by-law aims to enhance safety and regulate surveillance, it presents several challenges:

  • ADMINISTRATIVE DELAYS:

    • The requirement for approval may slow down the installation of much-needed security infrastructure, leaving high-crime areas vulnerable.

  • FINANCIAL BURDEN:

    • Registration and compliance fees may discourage private individuals and businesses from installing CCTV systems, reducing surveillance coverage.

  • RESTRICTED ACCESS TO FOOTAGE:

    • Delays in accessing footage could hinder crime investigations and emergency responses, limiting the effectiveness of surveillance as a crime-fighting tool.

  • IMPACT ON COMMUNITY POLICING:

    • Neighbourhood watch programs and private security networks rely on CCTV footage for crime prevention.

    • This law may hinder their ability to monitor and respond to incidents effectively.

  • PRIVACY AND DATA PROTECTION CONCERNS:

    • Clear guidelines on data management, access, and retention are needed to prevent misuse of footage and ensure that privacy rights are respected.
