PROJECT: KNOW YOUR RIGHTS AS A COMPLAINANT CONCERNING THE REFUSAL BY SAPS MEMBERS TO OPEN DOCKETS

Specialised Security Services has noted that the public finds it difficult to open criminal cases at police stations.

In light of the apparent difficulty in registering cases with the Police, all members and citizens should be aware

of the following National Instructions concerning SAPS members opening cases or registering a criminal offence.

 
  • The public finds it difficult to open criminal cases at police stations.

  • It is not necessary for the complainants to bring the suspect/s to the police station.

  • It is not necessary for the complainants to identify the suspect/s by name.

  • In many instances, members of the public are informed by the Police that the crime did not occur in their precinct and, therefore, they cannot open a case.

    • This is not the truth and UNACCEPTABLE.

    • Police Management condemns these excuses in the strongest terms.

    • The Police have strict instructions that any criminal matter must be attended to.

    • The complainant must be interviewed and a statement must be taken. The specific docket must be sent to the precinct where the crime occurred.

    • The Police have standing instructions on how to forward the particular docket to the applicable police station.

  • The police member attending to the complainant cannot unilaterally decide that the matter is not serious enough and, therefore, does not warrant the opening and registering a criminal case.

    • This practice is also UNACCEPTABLE and strictly prohibited by Police Management.

    • Each shift has a commander on duty that has to check the specific the matter when the complaint is registered.

    • If a senior member is not available to do this, the complainants can also see the station commander, the branch commander of that specific police station, or any other senior member.

  • It happens that complainants are told that they should sort the matter out with the suspect/s.

    • This is totally incorrect.

    • Criminal matters must be opened after the complainants are interviewed thoroughly.

  • According to Section 2 of the National Instruction, a complainant must never be referred to another police station, even if the crime was committed in another police station area.

    • Complainants must be assisted at the police station where they report the matter.

  • Community Services Centres are responsible to ensure complainants or reporters of crimes are taken at the Community Centre if that crime was committed withing that Police Precinct or any other precinct.

  • Community Service Centres are responsible to ensure that a reported crime receives the necessary attention immediately and that the necessary role players are contacted to ensure that the crime received immediate investigation.

  • All district commanders, and especially station commanders, must ensure that these instructions are adhered to and that necessary disciplinary action is taken against members who do not comply.

    • Any such contravention would be deemed a serious offence.

  • Members of the public must report if the Police refuse to open any criminal matter they report.

 

When you are not assisted in opening a criminal case at any police station, report the incident to

the SAPS National Complaints Center.

Greetings - again - and many thanks, actually to all public spirited security services including the urban-rural and rural--urban, including the planet earth and what we understand of the cosmopolitan cosmos as we wend our ways and tover our views; and help redefine our spaces, places and stoeptalks ahead. Whatever happened to the slew of talks on gender and corruotion issues all round in places including such as the school staffrooms and playing fields of and around umsobomvu municipality, the local regional and provincial SAPS, the local regional and provincial departments of basic education?
