Child pornography is a grave concern in South Africa, with significant implications for the safety and well-being of children. According to a 2016 report by UNICEF and the Centre for Justice and Crime Prevention, approximately 20.5% of child participants reported receiving unsolicited advertisements or links to pornographic websites,
often from friends or strangers met online.
In 2016, the Committee on the Rights of the Child expressed concern about the reported increase in cases of online child sexual exploitation in South Africa. A 2024 report highlighted that 19% of children aged 9-17 in South Africa had experienced online exploitation and abuse, underscoring the growing threat of child pornography and related offences in the digital age. Child pornography in South Africa is intricately linked to various other criminal activities,
creating a complex web of exploitation and abuse.

For example, in 2013, South African police arrested six men suspected of being part of a global child pornography network, highlighting the transnational nature of this crime.

TECHNOLOGICAL BARRIERS:
Using advanced technologies and encrypted platforms by offenders makes detection and investigation challenging for law enforcement agencies.
RESOURCE CONSTRAINTS:
Limited resources and specialized training within law enforcement hinder effective monitoring and intervention.
LEGAL AND JURISDICTIONAL ISSUES:
The international dimension of child pornography complicates legal proceedings, as coordinating with foreign jurisdictions can be cumbersome.
LEGISLATIVE FRAMEWORK:
South Africa has enacted laws to combat sexual offences, including those related to child pornography.
The Criminal Law (Sexual Offences and Related Matters) Amendment Act, 2007, criminalises various acts such as the creation, possession, and distribution of child pornography, as well as the sexual grooming of children.
In recent years, South African authorities have intensified efforts to combat child pornography.
For instance, in December 2024, two individuals in Gauteng were arrested for charges
including sexual grooming and the distribution of child pornography.
Despite these efforts, the pervasive nature of child pornography and its links to other forms of child exploitation remain significant challenges. Continuous advancements in technology and the internet's global reach necessitate ongoing vigilance and international cooperation to address these interconnected crimes effectively.
